                          Vastavalt RHS § 111 märgib pakkuja pakkumuses, milline teave on pakkuja ärisaladus ning põhjendab teabe ärisaladuseks määramist.

                          Hankija ei arvesta majanduslikult soodsaima pakkumuse väljaselgitamisel olelusringi kulusid, sest hanke eesmärk on raamlepingu alusel arendus- ja hooldusteenuse tellimine lähtuvalt hankija vajadusest nii juba olemasolevatele kui ka loodavate lahendustele ning seetõttu ei ole võimalik tehtavaid ega kasutamisjärgseid kulusid määratleda ega hinnata.

                          Otstarbekuse kaalutlustel jätab hankija hanke osadeks jaotamata, kuivõrd hanke esemeks olevad tooted/teenused on koostoimivad.

                          Pakkuja peab talle allkirjastamiseks edastatud lepingu allkirjastama hiljemalt 10 tööpäeva jooksul. Antud tähtaja jooksul lepingu allkirjastamisest keeldumist on Hankijal õigus käsitleda kui RHS § 119 lõikest 1 nimetatud eduka pakkumuse esitanud Pakkuja poolset lepingu sõlmimisest keeldumist ja pakkumuse tagasi võtmist.
